Important Update Regarding Trademarks in Bermuda
The Bermuda Registry General has updated the effective date of Bermuda’s eagerly awaited new trademarks law, the Trade Marks Act 2023. The “anticipated” effective date is now February 1, 2025 (it had been January 1).
The new law brings welcome updates such as provision for certification and collective marks plus non-traditional marks such as colors and sounds, removal of the A/B-split registration system with different rights conferred under each part, and 10-year registration terms (currently 14 years).
It is worth noting that the anticipated effective date could change again, and a formal commencement notice will be issued one month prior to the Act coming into force. We will keep clients updated on any future developments.
