Puerto Rico
Puerto Rico is an unincorporated territory of the United States. Manufacturing, tourism, and services form major components of its economy. A rich culture, centuries-old forts, and Spanish colonial architecture draw tourists from around the globe. Puerto Rico maintains a local trademark system analogous in some respects to a U.S. State. A local registration does not rely on a federal registration with the USPTO and may allow certain advantages over relying on a federal registration. Of note, the local legal system conducts its affairs in Spanish, while the federal courts operate in English.
Trademark Rights
Trademarks and service marks are eligible for registration in Puerto Rico. The following rules and regulations apply:
Prior use: None required
Classification: Nice Classification (single class filing only)
Registration term: 10 years from the date of registration and renewable for 10 year periods
A Statement of Use must be filed during the sixth year of registration and during the renewal period
Non-use vulnerability: 3 years
