Turks and Caicos Islands
Comprising numerous low-lying coral islands in the Atlantic Ocean, Turks and Caicos is a British Overseas Territory. The islands are known for their salt sponge production and hemp product manufacturing as well as scuba-diving and tourism. Offshore finance and fishing are also major components of the economy.
Trademark Rights
Trademarks and service marks are eligible for registration in the Turks and Caicos Islands. The following rules and regulations apply:
Prior use: None required
Classification: Nice Classification (single class filing only)
Registration term: 10 years from the date of filing and renewable for 10 year periods
A annual maintenance fee is required with a one-month grace period for late filing
Non-use vulnerability: 5 years
Extension of Rights
Registration is possible upon the basis of a fully registered United Kingdom trademark. UK-based registrations are granted via an application which extends trade and service mark rights based on the original date of registration for the underlying UK mark. The term for these registrations will coincide with that of the underlying UK mark.
